On Monday Barack Obama issued another executive order that creates a new government bureaucracy that will oversee restoration efforts in five Gulf States due to the 2010 BP oil spill. The Gulf Coast Ecosystem Restoration Council (GCERC), which is created by the EO, will be using eighty percent of the fines imposed on BP to assist in the restoration. No word has been given in regards to the remaining twenty percent of the fines.

The EO’s policy reads as follows:

Executive Order 13554 of October 5, 2010, was issued after the blowout and explosion of the mobile offshore drilling unit Deepwater Horizon that occurred on April 20, 2010, and resulted in the largest oil spill in U.S. history (Deepwater Horizon Oil Spill). Executive Order 13554 recognized the Gulf Coast as a national treasure and addressed the longstanding ecological decline of that region, which was compounded by the Deepwater Horizon Oil Spill. In doing so, Executive Order 13554 established a Gulf Coast Ecosystem Restoration Task Force (Task Force) to coordinate intergovernmental efforts, planning, and the exchange of information in order to better implement Gulf Coast ecosystem restoration and facilitate appropriate accountability and support throughout the restoration process.

Since the implementation of Executive Order 13554, the Federal Government’s Gulf Coast ecosystem restoration planning efforts have advanced significantly. The Task Force’s Gulf of Mexico Regional Ecosystem Restoration Strategy (Strategy), created with input from Federal, State, tribal, and local governments, and thousands of involved citizens and organizations across the region, serves as a comprehensive restoration plan for addressing ecological concerns in the Gulf of Mexico. In light of the release of the Strategy, the ongoing work of the Natural Resource Damage Trustee Council (Trustee Council) under the Oil Pollution Act, and the recent passage of the Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies of the Gulf Coast States Act of 2012 (RESTORE Act) (title I, subtitle F of Public Law 112-141), this order affirms the Federal Government’s Gulf Coast ecosystem restoration efforts and realigns responsibilities to ensure the most effective governmental planning and coordination to reach these goals.

The Gulf Coast Ecosystem Restoration Task Force (GCERTF) was created in 2010 and was charged with “development of a restoration strategy that proposes a Gulf Coast ecosystem restoration agenda.” The EO terminates the GCERTF and establishes the GCERC.

Obama also named the Environmental Protection Agency and the Department of Agriculture to serve as designated federal trustees in the project.

Garret Graves, executive assistant to Gov. Bobby Jindal for coastal issues, praised the selection of EPA and the Agriculture Department to the remediation council, saying both, in particular EPA Administrator Lisa Jackson, did important work helping the task force establish important ecosystem restoration goals.

But he said dissolving the task force, which he co-chaired with Jackson was a mistake because it has not completed working out a way to reduce the bureaucratic delays that have been an impediment to past coastal restoration and flood control projects and can continue to be burden, even now when the Restore Act promises to provide substantial funding. Graves said the new council that will determine how to spend Restore Act money doesn’t have the statutory authority to recommend changes in bureaucratic procedures to speed key environmental projects.

“I commend the president for establishing the Task Force and Administrator Lisa Jackson and New Orleans native did a phenomenal job herding the cats on the task force,” Graves said. “The December 2011 strategy document identified key bureaucratic obstacles that have been impeding hurricane protection for our communities and coastal restoration for decades.”

“However, we have strong concerns with the void created by dissolving the Task Force,” he said. “The establishment of the task force and the promise of cutting through the red tape and dysfunction was like getting invited to a big night in New Orleans with dinner at Commander’s Palace and great live jazz. Instead, I feel like we just got dropped off in the Maurepas Swamp to survive on bullfrog sushi.”

Ms. Jackson also stated, “Thanks to the leadership of task force co-chair Garret Graves of Louisiana and representatives from Texas, Alabama, Mississippi and Florida, participation from 11 federal agencies, and extensive input from members of the public, the strategy identified three key actions needed to restore the Gulf’s natural resources – stopping the loss of wetlands, reducing the flow of nutrients into the Gulf, and enhancing resiliency among coastal communities.”

“As the Task Force’s responsibilities transition to the Gulf Coast Ecosystem Restoration Council, I look forward to continuing our work and, along with my colleagues, remain firmly committed to advancing the region’s economic and environmental health and ensuring the Gulf comes back stronger than before the Deepwater Horizon oil spill,” Jackson said.

Conservation groups also praised Obama over the new EO:

Today, local and national conservation organizations thanked President Obama for issuing an executive order reinforcing the White House’s commitment to Gulf Coast restoration in the wake of the 2010 gulf oil disaster. The order was issued two months after the President signed the RESTORE Act into law, which will direct 80 percent of the Clean Water Act penalties paid by BP and others responsible for the 2010 gulf oil disaster to the Gulf Coast states to use for restoration.

“We thank the President and White House for their continued commitment to the Gulf Coast and look forward to working with them on a comprehensive restoration plan,” said a joint statement by Environmental Defense Fund, National Audubon Society, National Wildlife Federation, Coalition to Restore Coastal Louisiana and Lake Pontchartrain Basin Foundation. “More than two years after the oil spill, the gulf is still reeling from environmental and economic impacts. This executive order takes important steps forward to ensure that government agencies and officials are working closely together to keep restoration progressing.”

“Through today’s executive order and the Department of Justice’s recent assertion that BP was ‘grossly negligent’ in the 2010 gulf oil disaster, the federal government is showing a true prioritization of gulf restoration,” the groups continued. “The people, economies and ecosystems all along the gulf need BP to be held accountable to the fullest extent of the law. The sooner BP pays its fines, the sooner gulf restoration can become a reality.”

The group is calling on BP to pay its fines, which may be as high as $20 billion, if found negligent. What they are not talking about is Barack Obama’s own negligence at the time of the spill, nor do I expect them to do so.

An executive order is being drafted by the Obama administration that would create a program that protects vital computer networks from cyber attacks. The news comes from two former government officials with direct knowledge of the effort, according to Bloomberg.

“An executive order is one of a number of measures we’re considering as we look to implement the president’s direction to do absolutely everything we can to better protect our nation against today’s cyber threats,” White House spokeswoman Caitlin Hayden said in a statement today. “We are not going to comment on ongoing internal deliberations.”

The Obama administration is preparing an executive order with new rules to protect U.S. computer systems, after Congress failed earlier this summer to pass a cybersecurity bill. The provisions include voluntary standards for companies, a special council run by the Homeland Security Department and new regulations covering especially vital systems, according to a draft of the order obtained by The Associated Press.

National security officials have warned that electric grids, water plants, banks and other essential industries operated by the private sector are vulnerable to cyber attacks. Yet there are deep divisions over the best approach for keeping hackers and other criminals, foreign governments or terrorist groups from penetrating these systems, which rely heavily on computer networks to remotely control switches, valves and terminals.

Critical infrastructure systems provide services that are part of everyday life. But an enemy with the proper know-how could cause catastrophic damage and chaos by giving them incorrect commands or infecting them with malicious software. Potential nightmare scenarios include high-speed trains being put on collision courses, blackouts that last days or perhaps even weeks, or chemical plants that inadvertently release deadly gases.

Last month, White House counter terrorism adviser John Brennan said, “If those intruders get into those systems and then can determine how they can in fact interfere in the command and control systems of these systems, they can do things.”

“If the Congress is not going to act on something like this, then the president wants to make sure that we’re doing everything possible,” Brennan said.

Senate Republicans block the cyber security bill that came before them earlier this year citing Constitutional and privacy issues. Brennan claims that opponents misrepresented the bill, which he claims called for “minimum performance standards.” “Believe me, the critical infrastructure of this country is under threat,” Brennan said, adding that foreign states and hackers “are developing advanced technologies, and we have to improve our defenses on this issue.”

Bloomberg reports,

This is the big issue. How much control will the federal government have over the internet and those that use it. The Department of Homeland Security has already demonstrated its inability to handle such power and with such power government ends up becoming tyrannical.

The Obama administration is already circulating a draft presidential directive dealing with a related issue: collecting and disseminating information about cyber security threats. That reflects “early” discussions about how to update a 2003 directive for protecting the most critical U.S. assets and “is not close to being done,” Hayden said on Aug. 29.

One issue that the proposed directive didn’t clearly explain is how much authority DHS would have to tell businesses what they must do to protect their computer systems from attack. The document says only that the department would plan “requirements for vulnerability and risk assessments.”

Presidential directives typically address national security or foreign policy matters. They are issued by the National Security Council and may be classified. The directives carry the same weight as executive orders, which deal with management and operations of the executive branch.

Between conservatives focusing all their attention on the successes/failures of the Republican National Convention in Tampa, Fla., and the left having a meltdown over the supposed “racism” and unprecedented disrespect of Clint Eastwood’s “Empty Chair” routine, little attention has been given to an executive order issued last Thursday by President Barack Obama that targets industrial “efficiency” and carbon emissions.

“Today, we are taking another step to strengthen American manufacturing by boosting energy efficiency for businesses across the nation,” said President Obama.

“This action will cut costs, increase efficiency, and help our businesses create strong, middle class jobs.  We’ll continue to do everything we can to put more people back to work and build an economy that lasts,” he added.

The order, which aims to increase the number of cogeneration plants in the U.S. by 50 percent by 2020 and slash carbon emissions by 150 million tons per year, is the administration’s latest effort to “deploy cleaner and more efficient energy production in the country by working around political resistance to climate change and ‘green’ energy legislation on Capitol Hill,” Reuters reports.

“The Federal Government has limited but important authorities to overcome … barriers, and our efforts to support investment in industrial energy efficiency and CHP [Combined heat and power] should involve coordinated engagement with a broad set of stakeholders,” the order says.

Translation: If duly elected representatives of the people get in the way of “climate change” (formerly known as “global warming,“ formerly known as ”global cooling”) legislation, work around them.

“The man is legislating by presidential fiat!” conservative author and radio show host Mark Levin said Friday. “This is unconstitutional.”

The order dictates that the Departments of Energy, Commerce, and Agriculture, and the Environmental Protection Agency coordinate their actions to provide “policy and technical assistance” to states in order to ensure energy efficiency targets are being met.

What could possibly go wrong?

The order also “establishes a new national goal of 40 gigawatts of new combined heat and power capacity by 2020, a 50% increase from today,” according to a statement from the White House.

“Meeting this goal would save energy users $10 billion per year, result in $40 to $80 billion in new capital investment in manufacturing and other facilities that would create American jobs, and would reduce emissions equivalent to 25 million cars,” the statement adds.

Sure, it sounds nice and (like most things in this administration) it promises a great return on investment, but are there any possible downsides to this executive order?

“This is a fiat from on high for these utilities to change the way they process energy — anenormous capital expense and many of them are going to close down,” Levin argued. “And they only have eight years to do it as part of this ‘cap-and-trade,‘ ’green’ energy, ‘climate change’ bull crap.”

“You’re going to see your bills go up, up, and up some more. And you’re going to see brownouts and one day blackouts,” he added.

But more than the possible economic burden the order may cause, Levin takes umbrage with the fact that the president keeps issuing these types of orders.

“The fact of the matter is he doesn’t have the power to mandate this. We don’t have a king who decides, ‘you know what? You utilities, this is how you’re going to process energy.’ Imperial president! … [T]he very nature of our government, our very constitution is under attack,” Levin said Friday.

Internet Censorship Via Executive Order

Some lawmakers want Internet censorship via Presidential executive order.

There was a fight earlier this year about Internet freedom and privacy as Congress attempted to create legislation (SOPA, PIPA, CISPA, ACTA) that would give government more control over the Internet. When Internet companies and the public expressed disdain for such a measure, legislators backed down.

Now they have a different plan.

Senate Intelligence Committee Chairwoman Dianne Feinstein (D-Calif.) sent a letter earlier this week to President Barack Obama urging him to forgo Congress and pass cybersecurity legislation via his powers of executive order.

“While efforts to reach consensus continue, I fear that the Congress will be unable to pass meaningful cybersecurity legislation this year. Therefore, I believe the time has come for you to use your full authority to protect the U.S. economy and the networks we depend on from future cyber attack[s],” Feinstein contends. “While an executive order cannot convey protection from liability that private sector companies may face, your administration can issue cybersecurity standards and provide technical assistance to companies willing to take voluntary steps to improve their security.”

The Senator believes that the Nation faces grave and imminent national and economic security implications as long as the Internet is free and that there is no time to wait for Congressional legislation.

“These are meaningful, if limited, steps that can be taken now,” she said. “The threats to our national and economic security are simply too great to wait for legislation.”

Feinstein said the President should also encourage more collaboration between the Department of Homeland Security and private enterprise in the way of information sharing in order to lessen threats to national security.

A plea similar to Feinstein’s was made earlier in the month by Senator Jay Rockefeller (D-W.Va.), who also cosponsored Senator Joseph Lieberman’s latest attempt at legislation ceding control over the Internet to the government.

“[B]ecause it is very unclear whether the Senate will come to agreement on cybersecurity legislation in the near future, I urge you to explore and employ every lever of executive power that you possess to protect this country from the cyber threat,” Rockefeller wrote in a letter to Obama. “We must act to address our cyber vulnerabilities as soon as possible and many components of the Cybersecurity Act are amenable to implementation via executive order, normal regulatory processes, or other executive action under the authorities of the Homeland Security Act.”

Cybersecurity bills that have already been proposed have been met with harsh criticism from a number of conservative lawmakers, along with the U.S. Chamber of Commerce and a number of Internet-based companies. The critics say that such legislation opens the door for the Federal government to impede Internet commerce with burdensome regulation and could have a damning effect on Internet free speech.

White House chief counterterrorism adviser John Brennan has said recently that the Obama Administration is considering the possibility of Internet regulation through executive order in the wake of recent failed legislative attempts to implement the controls.

After defeat of Senate cybersecurity bill, Obama weighs executive-order option

Senate Republicans recently blocked cybersecurity legislation, but the issue might not be dead after all.

The White House hasn't ruled out issuing an executive order to strengthen the nation's defenses against cyber attacks if Congress refuses to act.

“In the wake of Congressional inaction and Republican stall tactics, unfortunately, we will continue to be hamstrung by outdated and inadequate statutory authorities that the legislation would have fixed," White House Press Secretary Jay Carney said in an emailed response to whether the president is considering a cybersecurity order.

"Moving forward, the President is determined to do absolutely everything we can to better protect our nation against today’s cyber threats and we will do that," Carney said.

The White House has emphasized that better protecting vital computer systems is a top priority.

The administration proposed its own legislation package in 2011, sent officials to testify at 17 congressional hearings and presented more than 100 briefings on the issue. In a recent Wall Street Journal op-ed, President Obama warned that a successful cyber attack on a bank, water system, electrical grid or hospital could have devastating consequences.

The president urged Congress to pass the Cybersecurity Act, which was offered by Sens. Joe Lieberman (I-Conn.) and Susan Collins (R-Maine). The bill would have encouraged private companies and the government to share information about cyber threats and would have required critical infrastructure operators to meet minimum cybersecurity standards.

But Senate Republicans, led by Sen. John McCain (R-Ariz.), worried the bill would burden businesses with unnecessary and ineffective regulations. 

The bill's sponsors watered down the regulatory provisions, replacing the security mandates with voluntary incentives, but that wasn't enough to win over Republicans. The bill mustered 52 votes in the Senate, well short of the 60 needed to overcome a filibuster.

If Obama issues an order on cybersecurity, it wouldn't be the first time that his administration has resorted to executive action to bypass Congress.

Obama uses the slogan "we can't wait" to argue that some issues are too important to be allowed to stall in Congress.

When lawmakers refused to pass the Dream Act to give legal status to students brought to the country illegally, the administration announced that it would stop deporting young immigrants who would have been eligible to stay under the bill.

Jim Lewis, a senior fellow at the Center for Strategic and International Studies, explained that Obama could enact many of the core provisions of the Cybersecurity Act through executive order.

Many companies managing vital computer systems are already heavily regulated. Lewis said the president could order agencies to require the industries they regulate to meet cybersecurity standards.

"You don't need new legislative authority to do that," Lewis said.

He noted that some regulatory agencies, including the Federal Communications Commission and the Nuclear Regulatory Commission, are independent and not bound to follow executive orders. But Lewis predicted that even the independent agencies would likely enforce an executive order on cybersecurity.

Lewis said the Office of Management and Budget is already working on security standards for federal computer systems, and said those guidelines could form the basis of standards for the private sector.

Lewis acknowledged that the provisions of the Cybersecurity Act that would have torn down legal barriers to information-sharing would have to be enacted by Congress. Although those provisions were the ones most strongly supported by the business community, Lewis expressed skepticism that they would do much to improve cybersecurity anyway. 

"You can have them or don't have them. Who cares," he said.

But Lewis said that an executive order could even partially address information-sharing. The FCC, for example, has set up a voluntary system for companies to share information about cyber threats with each other, he said.

An executive order may accomplish many of the goals of the Cybersecurity Act, but it could also further raise the ire of Republicans and the business groups, such as the U.S. Chamber of Commerce, who lobbied against the legislation. 

Republicans have already accused President Obama of making illegal power grabs with his previous executive actions, and a cybersecurity order would likely elicit similar howls of disapproval.

Although Sen. Collins was frustrated by the defeat of her bill, she reacted coolly to the idea of the president bypassing Congress.

"I'm not for doing by executive order what should be done by legislation," she said.

Sen. Dianne Feinstein (D-Calif.), one of the main co-sponsors of the Cybersecurity Act, said she prefers that Congress address the problem, but she is open to presidential action if Congress fails.

"I suppose if we can't, the answer would be yes," she said when asked whether she would support an executive order.
